Licensing law

Our licensing team

Pacta sunt servanda

Contracts must be honored - a fundamental principle of our legal system.

License and know-how agreements can determine the weal and woe of your entrepreneurial assets. You should therefore place the drafting and negotiation of contracts involving aspects of intellectual property and copyright in the hands of competent and experienced legal and patent attorneys.

At HERTIN & Partner, we have extensive experience in drafting, reviewing and negotiating license and know-how agreements in the fields of intellectual property and copyright law. We know which provisions must be included in your contracts and where the pitfalls are that you should avoid.

What we do for you

We advise and accompany you in clarifying the legal framework and factual basis as well as, if necessary, your contract negotiations for a (also international) license and know-how agreement in patent, trademark, copyright or design law, including influences of antitrust law.

We review and draft new contracts, including collaboration, distribution and research agreements, as well as accrual agreements and co-existence agreements.

However, our activities also include the drafting and implementation of purchase and transfer agreements involving industrial property rights such as patents or trademarks, etc.
